Trump Plans to Sue DOJ and FBI for $115 Million Over Alleged Political Prosecution
Former President Donald Trump is preparing to sue the U.S. Department of Justice (DOJ) and the FBI for $115 million, claiming “malicious political prosecution” and “abuse of process.” The legal notice, filed by Trump’s attorney Daniel Z. Epstein, accuses the DOJ leadership and Special Counsel Jack Smith of pursuing a politically motivated case designed to prevent Trump’s re-election.
Epstein, a former Trump White House lawyer and now vice-president of America First Legal, asserts that the investigation has cost Trump millions in legal fees and tarnished his reputation. The notice specifically criticizes the FBI’s search of Trump’s Florida estate in August 2022, where classified documents were seized, leading to Trump’s indictment.
Trump’s legal team argues that the search violated established protocols for former presidents and was part of a broader effort to undermine his political ambitions. Despite the National Archives and DOJ’s multiple requests for the return of the documents, Trump’s team insists the government could have obtained the records without the search.

The lawsuit claims Trump suffered $15 million in actual damages from legal costs and is seeking an additional $100 million in punitive damages. This move is part of Trump’s broader campaign against what he calls the “weaponized Department of Justice.”
The legal notice, filed on August 7, is a prerequisite for most civil claims against the government. If no response is received within six months, Trump can proceed with the lawsuit, which is expected to be filed in Florida’s Southern District, where U.S. District Judge Aileen Cannon dismissed a related case last month.
