AGF Declares NLC and TUC’s June 3 Strike Notice Illegal and Premature

The Attorney General of the Federation (AGF) and Minister of Justice, Lateef Fagbemi, has declared the June 3, 2024, strike notice by the Nigeria Labour Congress (NLC) and Trade Union Congress (TUC) as “premature, ineffectual, and illegal.”

In a letter dated June 1, 2024, addressed to NLC President Joe Ajaero and TUC President Festus Osifo, Fagbemi cited Sections 41(1) and 42(1) of the Trade Disputes Act 2004, which mandate a minimum 15-day strike notice. The labour unions had announced the strike due to the Federal Government’s failure to agree on a new minimum wage and reverse the electricity tariff hike.

The unions rejected the government’s offer of ₦60,000, insisting on ₦497,000 as the new minimum wage. Fagbemi urged the unions to return to the negotiation table, emphasizing that dialogue is a more progressive path than industrial action. He also highlighted a June 5, 2023, court order restraining the unions from any industrial action, which remains binding.
