After Nearly Two Decades of Legal Protection, EFCC Finally Gets the Green Light

In a historic ruling on March 10, 2025, Nigeria’s Supreme Court has officially paved the way for the Economic and Financial Crimes Commission (EFCC) to investigate the administration of Dr. Peter Odili, who served as the governor of Rivers State from 1999 to 2007.

This landmark decision, delivered by a five-justice panel led by Justice John Okoro, dismissed appeals filed by the Rivers State Attorney General and the Speaker of the Rivers State House of Assembly. The ruling effectively ended the legal shield that had protected Odili from scrutiny for nearly two decades, allowing the anti-corruption agency to reopen investigations into his time in office.


The Origins of the Legal Battle

The legal standoff began in 2007, right after Odili completed his tenure. He secured a perpetual injunction from the Federal High Court in Port Harcourt, barring the EFCC from:

  • Investigating his administration
  • Probing Rivers State’s finances from 1999 to 2007
  • Taking any legal action against him

For years, this injunction stood firm, frustrating the EFCC’s efforts to examine allegations of financial mismanagement. The commission formally contested the ruling in 2008, but its efforts remained stalled — until a significant breakthrough in 2018.

That year, the Court of Appeal granted the EFCC leave to challenge the 2007 ruling, reigniting the legal battle. In response, the Rivers State Attorney General and the Speaker of the House of Assembly filed separate appeals (SC/CV/318/2018 and SC/CV/447/2018) to block the commission’s renewed push for accountability.


Supreme Court’s Decisive Verdict

During the hearing on March 10, 2025, the Supreme Court panel, led by Justice Okoro, dismissed the appeals, describing them as interlocutorypreliminary issues rather than the core dispute.

“This is not the type of appeal we hear here,” Justice Okoro stated, advising the parties to resolve the substantive matter at the Court of Appeal before approaching the Supreme Court.

Realizing the legal deadlock, S.A. Somiari, SAN, counsel for the appellants, withdrew the appeals. With no objections from the EFCC’s legal team — led by Abubakar Mahmud, SAN, Sylvanus Tahir, SAN, and B.O. Obialo — the Supreme Court dismissed both appeals.

“The appeal is dismissed, having been withdrawn without any objection,” Justice Okoro declared.


What This Means for Odili and the EFCC

This ruling marks a major victory for the EFCC, dismantling a nearly 18-year legal barrier and clearing the path for investigations into Odili’s eight-year administration in Rivers State — an oil-rich region critical to Nigeria’s economy.

With the legal shield lifted, the anti-corruption agency can now revisit allegations of financial mismanagement, misappropriation of state funds, and administrative misconduct that have long clouded Odili’s legacy.

For Dr. Peter Odili, a once-powerful political figure, this Supreme Court decision signals the end of his legal immunity and the start of a new chapter — one that could reshape the narrative around his time in office and political influence.
